Tonight’s UW-Milwaukee Student Association Senate meeting featured a controversial voice vote over a resolution supporting police action during the March 4 education rights protest at UWM.
Later in the meeting, multiple SA Sens. attempted to override SA Speaker Kyle Duerstein’s interpretation of the voice vote seen in the video below. That effort failed by one vote.
SA President Jay Burseth left the meeting at the end of this video and prior to his scheduled report.

Regardless of whether or not you agree with Speaker Duerstein, there is no doubt that this guy is fearless and top notch entertainment. Speaker Vega only did stupid pranks. Speaker Rueden only pocketed money. Speaker Bahr, eat your heart out. You ran some shady elections, but your Senate was obedient and boring. Sorry boys: The Blue Ribbon goes to SPEAKER DUERSTEIN!!

Duerstein’s arrogance knows no bounds. This moment did more to damage the SA’s public face as well as morale of the senators then anything thus far in the year. Regardless of his personal views, one would assume he’d have enough respect for his position to not abuse his power so publicly. At least this is his last year. Today, I’m embarassed to be part of an organization that’s lead by such a tyrant.

You will call on the UWM Administration (who you want nothing but to be rid of SDS)to help and they will do nothing because under Wisconsin law they can’t. Kyle, you introduced this piece of legislation to us RIGHT before we had to vote on it. This, first of all, was inappropriate. We didn’t go into debate because we were all dumbfounded on all the rude wording and the fact that you just wanted to “condemn” the 16….and for what reason? To show your power over groups who actually try to better the university you attend? Let’s see you try to better the quality of our education… at least the supporters on March 4th TRIED. Maybe the results didn’t come as everyone wanted, but they did get INTERNATIONAL NEWS supporting lower tuition because of their arrests.

I didn’t introduce a single thing during the entire meeting. Not one thing. A senator made a motion to add it to the agenda, that motion passed. The author read the resolution to the Senate, I, as per usual, gave time for questions. None were asked. I then, as per usual, gave time for debate. None was had. Because this is a Senate Resolution, we went into voice vote because of the non-binding and non-legislative nature of the resolution, and the voice vote passed.
Not once did ANY Senator ask for more time to think about questions or to form debate. Not once.
Let met share with you a little history. Think back to the Feb. 28 Senate meeting. A piece of legislation that would raise segregated fees by $130 was introduced to pay for a Union Renovation. No one debated it. It passed. Fast forward to March 9. A Senate Resolution taking an opinion, non-policy stance on an issue is presented. No one debated it. It passed.
That’s what happens when you don’t actually participate. You are more likely to get an outcome that you’re dissatisfied with. Chastise me all you want, if you didn’t debate the resolution, or ask for more time, or ask questions, it’s not MY fault the vote didn’t go your way.

Motions for division need to be made once one thinks there is confusion regarding the vote total, and must be made BEFORE the vote outcome is announced by the meeting chair. Calls for division and motions for an alternate vote method were made prematurely, and were not made by Senators recognized to hold the floor. Everyone speaking that is not recognized by the chair to do so is out of order, therefore, so were the motions you refer to. All year, I’ve run a tight ship. All year, I’ve done things in accordance with the bylaws and procedure. Why should I stop now, just because people got emotional and tried to break the rules by being out of order.
And, the Senator making the objection was not African American. Senator Banks, the only African American Senator present at the March 9 meeting was among those who eventually preferred a role call vote, but again, he did so joining other Senators who decided after the vote, in fact during the consideration of approval of the minutes, the next item on the agenda, that it would be the proper time to debate the previous piece of legislation that was already acted on. Again, debating a resolution after it passes is inappropriate. It was not the item on the floor at that time.

Don’t get self-righteous and use veil of “following parliamentary procedure” to justify your actions last night. It’s quite clear on the video that you gave three seconds for questions and three seconds for debate. You began to call the question and out comes debate. You stifle it because it doesn’t fit your agenda. The nays were louder and, from what several senators have said, more numerous. You gave no time for a question of division between the “nay” votes and decision. This is the tip of the iceberg, and people are beginning to see how self-serving and petty you and your friends on the Senate, and in the College Republicans, really can be.
You’ll have a rude awakening when you enter the real world. Outside of UWM’s campus, you’re just another smarmy self-righteous prick that ends up announcing highschool baseball games and working security for some concert venue. It’s also quite clear from the video that no one raised their hand to participate in questions or debate. It’s also quite clear that no one raised their hand to ask for more time for questions or debate. A Senator called the question, and seeing no debate, the question was called. Debate did NOT start at that point. Improperly timed and unrecognized motions on how to vote were spewed about at that point, and because they were out of order, were rightfully ignored. I stifled no debate on this issue when debate on that issue was appropriate.
No one actually started attempting to debate the issue until the minutes from February 28 were motioned on and seconded. At that point, we were discussing the minutes, not the resolution that had already passed. Again, yelling louder does not make you the winner, it just means you yelled louder. I’m sorry that some of the Senators who were arrested in the March 4 protest think that they had more people on their side, but that seems a little bit biased to me.
I’m not concerned about what some anonymous person thinks about my future. It doesn’t matter to me one bit. Save your pity for yourself when you graduate and can’t be successful because “Concerned Student” doesn’t qualify for a name on a job application or a resume.
I heard Duerstein learned the method of governing that he employed on this video from Speaker Pelosi. He’d never admit it though! Go Dems go!!!

I tried to ask for more time for discussion, but you were focused on an outcome you had pre-envisioned, as evidenced by the large “No 16″ armband you wore while leading the meeting. Senator DeWees just got back to his seat and called the question. No vote was taken on ending time for debate and calling the question as is normally done when a Senator calls the question. I had my hand raised and at 2:25 in the video, I can be heard objecting to the question being called, but you were focused on your desired outcome.
Robert’s Rules 9th edition states “A member can demand a division from the momment the negative votes have been cast until the announcement of the result is complete and (if such point is reached promptly) until the question is stated on another motion.” Deputy Speaker Romero-Boeck clearly called for division prior to a question being stated on another motion.
Parlimentary procedure should not be used to obstruct the conduct of business, but should help the group operate smoothly and cordially.
Your behavior was an abuse of the procedures and spirit of parliamentary procedure.

I believe everyone was somewhat dumbfounded at what had just been proposed. Legislation condemning students and their actions? What does that even mean? Moreover, had the senate known you’d only entertain three seconds worth of questions before cutting everything short and moving straight to some voice vote I doubt they would have hesitated.
It’s not like there’s some magical clock in the sky that limits time for questions, debate, and division rebuttal on a dirty vote. You set those limits based off of what should be a unbiased and just process. Your idealism compromises your ability to hold this position. What are the procedures one needs to take to have the speaker removed from office?

If you were able to perform the duties of your job you would have given ample opportunity to call division, probably would have called it yourself. Again this is a total abuse of power. Most of the SA are using color of law by hiding behind their positions and meager threats of UWS 17 and 18 not realizing everything has to go through an investigation process.
They have written the by-laws as if it supersede the United States Constitution as well as the Wisconsin Constitution. Most of these people are liars and cowards who interpret fair play on their moral philosophy and their delusional merit instead of justice and fairness.
Since most of these people are not running for office next year, their next step will be to eliminate the UPASS and other things that assist a majority of students.

Everyone who’s been a senator for at least one meeting should realize that you need to think quickly to prepare proper motions at the proper time, or you will just be waving your arms and flapping your gums for naught.
Granted, the addition of an item after the agenda had been printed deprived any opposition time to organize their response, but such prior coordination should not be necessary if they would think quickly enough to realize, “Okay, to circumvent the opacity of a voice vote, we should motion for a roll call vote, and if we fail that by a narrow margin, maybe two or three of our opposition senator friends will arrive several minutes later so that we can motion to reconsider and then motion for a roll call vote if the reconsider motion succeeds.”
Because this strategy can be used for any bill, it’s due to sheer laziness and stupidity that opposition to the bill did not achieve conformance with the Senate’s parliamentary procedure when attempting to initiate a roll call vote. This spring, try electing a more intelligent, better prepared opposition whose members actually rehearse what to do in these situations.
But again, poor preparation on behalf of the opposition means that ASAP will steamroll to victory, which is itself ironic because new party leadership will take ASAP from a two-time election loser into the new decade as the dominant winner of the 2010 SA election.

So the SA has decided to support the Police’s actions in the protest on March 4th–so what? When a group that has no legal recourse in this matter offers an opinion (no matter what the opinion), nothing happens, right?
The students who were arrested and charged will deal with this issue through the US Court System. What does it matter what the UWM SA thinks about the legality of the Police’s actions when it is ultimately up to the courts to decide?
From the viewpoint of an outside observer, I am much more inclined to believe the Police’s side of the story. First, because a Police officer’s word carries a lot of weight, second, because the incentive of an officer to arrest a student is not as great as the incentive of a student to claim to be unlawfully arrested, and third, because the group of protesters got some of their facts wrong, and some of the ones who were arrested were found to have illegal drugs on them. Criminals with incorrect information vs. the Police: who are you going to side with?

After getting the opportunity to watch the video, and keeping in mind that motions for division can only be made after the votes have been cast but before the chair announces the outcome, it seemed, from this video, that there is no time to motion for division.
Duerstein says “the aye’s have it” immediately after the “nay’s” are heard–there is no pause in which a motion for division could be made. Is this what people are upset about? I saw that time was given for questions (and not utilized by the group), but is it in accordance with the rules of parli pro to NOT allow any time after the vote, but before the outcome is announced (the time in which a motion for division could be made)? If so, it seems that there is a problem with parli pro in that it would be impossible to motion for division in cases like these.

It has been practice that where ambiguities exist in the documented parli pro, the Speaker interprets whether a type of motion may be performed. In this case, a senator would need to successfully motion to reconsider due to the lack of any discernible time (greater than a few microseconds) between nay voting and result announcement.

If this had happened at an NDSU Student Senate meeting, we’d already have the petition circulated and on the desk of the Student Court to oust the President of the Senate. It looks like your assembly is set up a bit differently, but there must be a way to recall him. The chair’s style was intimidating and quite obviously meant to silence any well-thought discussion. Don’t you have to call for debate three times under Robert’s Rules? The parliamentary authority of a body should never be used to ram through legislation like that.
As far as I’m concerned, everyone should have walked out with the President. You can justify it with precedence, rules, and procedure all you want, but the process was obviously a sham, whether or not the roll call vote would have turned out the same.

Well, after a maddening twenty-four hours or so, this issue is over. The actual issue about the senate resolution is over that is. The resolution has been deemed unlawful, and thus withdrawn unless changed to a legislative piece, so there’s a victory.
The main point however, being the brutish way the resolution was pushed through, continues to draw questions from many SA members. For now, those like myself, who are angry about this, will probably just have to wait till the next SA senate meeting to see how this is resolved.
Jay Burseth walked out to be a prima donna. He knows he’ll never be a big star like Duerstein or Kristopeit. Despite neither of the latter having been SA President, each has more charisma and credibility than Jay.
We know from the “SA fireside chats” that Jay couldn’t draw a crowd at an SDS flea market. The only times students have shown up for the chats were when the true stars of SA took time from their busy Senate schedule to show up. Senate meetings have revolved around Duerstein and Kristopeit because those are the guys who students want to see, not some metrosexual who’s too short for the podium microphone.

In this circumstance you are the chair, so therefore you chose to disregard the rumbles of dissent solely to please your personal agenda and serve your vindictive nature. So even if someone waited patiently to be ‘recognized’, you would still just ignore them, as clearly seen in this video. Your call on the vote was wrong, you just choose to not see that. As stated before, your idealism compromises your ability to hold this position. You are not fit to be the speaker of the house and this video, whatever you can clearly see out of it, the rest of us can clearly see exactly what happened. It’s no coincidence that the overwhelming majority of people who have commented on this video have had the exact same things to say about it as I do, it’s because we all see that same thing happening.

I was a parliamentarian of 10 years and I have most of Roberts Rules memorized.
If your constitution, bylaws, or other documents that define the rules and purpose of your Senate, spell out that you must utilize Roberts Rules of Order, then your interpretation is wrong. Completely wrong. From the beginning of the video, it is obvious that your body chooses a weak interpretation.
That being said…
If your documents specifically outline the requirement of Roberts Rules of Order, then you committed an unconstitutional procedure. You failed to recognize the call for Division as it is spelled out in Roberts Rules. You also failed to recognize the Point of Order. You must do so. You are bound as the Chair to do so.
It is a harder question concerning whether the vote is invalid – it would rest again over whether Roberts Rules of Order is defined as the parliamentary authority…and, even then, nobody did take the additional options used to block his authority.
You can motion to remove the chair without being recognized. If there is a conflict between your constitution and the parliamentary authority addressed in your constitution, then it should be resolved ASAP.
Regardless, there is the option to reconsider the question. I would invite Senators to do so. I would invite the Chair, if he is a just Chair as he claims he is, to honor this.
If the Chair continues to be an asshole, and his previous racist actions that I found on Google make me question his character, then Senate should consider their parliamentary options to strip his authority.
Until then, I’ll only add this final thing. I would not hire you Kyle for a job if you applied at my firm and I found this online. Regardless of “right” or “wrong” being in your favor (and I do believe the police were most likely just), you were an asshole. A complete asshole. I would not want to give you any sort of authority.
If you value your career and your future, I highly suggest you allow a reconsideration of the motion and follow strict Roberts Rules for that process.
Otherwise, you will continue to look like a bully.
Our bylaws outline Robert’s Rules of Order as advisory only, and give all parliamentary discretion to the chair. The issue has been resolved, at least somewhat. Thank you for your concern.

Most disappointing was how the senators acted. They just got steamrolled. Next time this happens. Appeal the decision of the chair (if he hears the motion), or remove him from office, or walk out of your meeting and sacrifice quorum.

Why do you have to put your two cent in to everything that is said and done on campus or about campus? Every time anyone says anything about UWM and/or the senate you have to have your own article or comment about. Your have done this on facebook and with the UWM post.

If people didn’t like the way you did the voting you should of did it again in the style that it is normally done(called each people by name). Then it wouldn’t of been such a big deal.

I refuse to do so because I was not present at the meeting and am not fully aware of the situation.
That being said, the constitution does grant the Speaker of the Chair all authorities unless Senate chooses to contest that authority and overrule it. The Chair was following one interpretation, though I feel it is an ethical perversion to not clearly justify why he/she is bending the recommendations of the constitution. Regardless, he was following one interpretation. Keep that in mind if you file a complaint.
However, here is what can be done for the future:
1)As a previous commenter noted, the option to rescind and to reconsider exists. They can be made as long as a current motion is not up for discussion.
2)If the Chair continues to dismiss things unfairly (like an attempt to reconsider the question), decisions can be overridden by a procedure outlined in the Bylaws. The emphasis on following Roberts Rules is stronger with that particular section of the Bylaws.
3)There is an Impeachment procedure outlined in the Bylaws if disparities continue.
4)Work on an amendment that makes Roberts Rules THE parliamentary authority and not a simple advisory tool. There is a procedure for that as well.
I would heavily advise for senators to take action and for actual UWM students to contact their senators and/or file a complaint through that process.
There are processes to use, and I would highly discourage the Speaker of the Senate to resist them without clear rationale for doing so.

While everyone is all up in arms about this Duerstein guy, who’s stopping Jay & Co. from spending nearly the entire SA travel budget on a spring break trip? Sounds a little more important then getting all worked up about a vote on a piece of legislation that ended up being nullified anyway due to issues unrelated to how it passed.
SA officials ALWAYS spend over half the SA travel budget every March. Same practice, different actors.
It’s just MORE interesting and MORE newsworthy when it’s coming from the guy who was arrested fighting “the man” and high tuition. Seems like he’s sure doing his part to help spend the money that comes in with the tuition payments!
Wow. You seem to know a lot about the SA, I did some more investigating and found that the Senate bought ALL new computers including MACs. Really? A conference that will leave the leadership in with legislators and able to bring back valuable information and pass it on for next year, sounds like a positive expenditure for me. New macs? Not so much.
The absurd element among SA travel and operations funding is that only SA officials wil directly benefit.
There has never been a public presentation as to what the SA officials purport to have learned from any conference, whether attendance was at USSA or a similar organization. No notes or handouts from the conferences have ever been displayed at Senate meetings or other places you might find SA literature.
Will the SA let the average student use their Macs when the CCLs are full, or will they be used exclusively to design SA flyers for the latest SA-funded activities and to watch the latest online news clips?

The symbol on Senator DeWees arm is an Iron Cross, which is a Prussian Military decoration. It was first issued in the early 1800s, and is not a Nazi symbol. It was used by the Nazis, but it was not something that was there own. Today the Modern German Army uses the Iron Cross, as it is an enduring German and Prussian Symbol. The Student Association Senate purchased 7 computers as part of a multi-year computer replacement plan signed by President Burseth. This included 2 macs (after the Exec branch was the first to purchase a mac for the SA several months ago) partly because the mac computers are greener and will last longer. Knowyourfacts…why don’t you know yours?
Why are we spending thousands of dollars to send the outgoing administration to an event for a group we aren’t even members of? It would make much more sense to send the incoming administration to a conference shortly after they take office so they can at least use what they’ve learned. All these yahoos are on their way out!
I have only just started to follow U.W.M.’s politics and I am already sick of Duerstein. His antics are reminiscent of a child’s. I assumed that we have all evolved since elementary level student council.

I support Kyle Duerstein and the vote to denounce the actions of the mob and the “Milwaukee 16.” By the way, give me a break you people are mocking real heroes who stood for civil rights and equality in America. Now the point of this post, how many days until Burseth and the rest of the former USSR are finally gone? That fool needs to be representing the student body as whole. His antics with the recent protest and his foolish participation at the Karl Rove event last semester show he is truely a “red” hell bent on reviving socialism on this campus. No judge would EVER side with the “mob” who rushed Chapman Hall that fateful day, get it through your heads.
Maybe the campus will luck out and Duerstein will drop over from a heart attack. What is he? 50? 60?
